1. Introduction and Scope
The Tracks Lounge ("Tracks Lounge," "we," "us," or "our") respects your privacy. This Privacy Policy describes the personal information we collect, the sources from which we collect it, how we use it, with whom we share it, and the choices and rights you may have.
This Privacy Policy applies when you:
- Visit our website at www.trackslounge.com (the "Site");
- Use any mobile application we may make available (the "App");
- Make a reservation, join a waitlist, place an order, join our mailing or text list, create a guest account, or leave ratings or reviews on our menus;
- Communicate with us, including by email, text message, phone, social media, or online forms submitted through the Site or App, such as contact, feedback, catering, or private event inquiry forms; or
- Otherwise interact with us where this Privacy Policy is posted or referenced.
Together, these are referred to as the "Services."
2. Information We Collect
"Personal information" means information that identifies you or could reasonably be linked to you. Depending on how you interact with us, we may collect the following categories of personal information:
Contact and profile information. Name, postal address, email address, telephone number, birthday, wedding anniversary, and a profile photograph if you choose to upload one.
Account information. Username and password for a guest account you may create through our Services. If you create an account using a third-party login, such as Google or Facebook, we may receive information permitted by your privacy settings on that service in order to create your account.
Content you submit. Ratings, written reviews, photographs, survey responses, and other content you choose to post or send to us.
Reservation, waitlist, and order information. Reservation, waitlist, and order history and frequency; items ordered; transaction amounts; pickup or delivery details; and special instructions you provide with a reservation, waitlist signup, or order.
Dietary and dining preferences. Dietary and dining preferences you choose to share with us, such as allergen information or dietary restrictions. Because these preferences can reveal information about health, religious beliefs, or disabilities, some states may treat them as sensitive personal information.
Loyalty, rewards, and gift card information. Information regarding your participation and status in any loyalty or rewards program we offer, such as points balances and redemptions, and information regarding gift cards you purchase, send, or receive, such as card values and balances.
Payment information. Order payments are processed by third-party payment processors. This may include payments made using digital wallets such as Apple Pay or Google Pay, if offered. We do not store your full payment card number. We may receive limited transaction information, such as card type, the last four digits, and confirmation of payment, needed to fulfill and support your order.
Device and usage information. Information about devices used to access the Services, such as IP address, device type, browser type, operating system, and user settings; pages and URLs that direct you to the Site, that you visit before arriving, and that you exit to; dates and times of visits; and information about actions taken on the Services, such as page views, time spent on pages, searches, and navigation patterns.
Your interactions with the Services, such as clicks, scrolling, and form navigation, may also be visually recorded and replayed by us and our platform provider to diagnose problems and improve the Services, a technology commonly known as "session replay."
General location information. General geographic location, such as country and city, inferred from your IP address.
Inferences and preferences. Preferences and inferences drawn from the information described above, such as favorite menu items or visit patterns, which may be used to personalize our offerings and communications.
Communications. The contents of messages you send us, your communication preferences, and records indicating whether marketing communications have been received, opened, or read.
3. Sources of Personal Information
- Directly from you, such as when you make a reservation, join a waitlist, place an order, create an account, post a rating or review, sign up for emails or texts, complete a form, request catering or a private event, or contact us.
- Automatically, through cookies and similar technologies when you use the Site or App and through information provided by your device's operating system.
- From other services we use, such as point-of-sale systems, reservation platforms, delivery marketplaces, or prior marketing providers, including when guest information is imported into our marketing and guest-management tools.
4. How We Use Personal Information
- To provide the Services, including processing, fulfilling, and communicating with you about reservations, waitlist signups, orders, catering inquiries, and private events; maintaining guest accounts; and displaying ratings and reviews.
- To send marketing and promotional communications, including emails and, with your consent, text messages concerning menu items, events, specials, promotions, and news.
- Some routine marketing emails may be scheduled and sent automatically, and some marketing content may be drafted with the assistance of automated and AI-based tools.
- To personalize the Services and our communications, including remembering your preferences and highlighting items we think you may enjoy.
- To operate, maintain, analyze, and improve the Site, App, and our business, including monitoring usage, troubleshooting issues, and developing new offerings.
- To protect against and prevent fraud, unauthorized transactions or access, and other liability, and to manage risk.
- To comply with legal requirements, enforce our terms and policies, and respond to legal process and requests from authorities.
- For other purposes described to you at the time information is collected or with your consent.
5. Text Messages
Marketing Texts
If you opt in to our marketing text-message program, we may send recurring marketing and promotional text messages, which may be sent using an automated system for the selection of telephone numbers. Consent to receive marketing texts is not a condition of any purchase. Message frequency varies. Message and data rates may apply.
Reply STOP to any marketing message to opt out or HELP for help.
Transactional Texts
Separately from any marketing text program, we may send transactional messages concerning requests you initiate. When you use your phone number to make a reservation, join a waitlist, or place an order, we may send texts concerning that request, such as reservation, waitlist, and order confirmations; pre-arrival reminders; place-in-line updates; table-ready alerts; order-status updates; and delivery-status updates.
These are informational messages rather than marketing messages and generally stop when the applicable transaction is complete. Message and data rates may apply. Reply HELP for help.
Mobile Information and Text Messaging Consent
No mobile information will be shared with or sold to third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with third parties.
Our messaging service providers process this information on our behalf solely to deliver messages you have requested. They act as service providers to us and are not considered third parties for purposes of this Privacy Policy.
Your consent to receive text messages from us is an agreement between you and us and is not transferable. We maintain records of your phone number and your opt-in and opt-out requests to operate our text-message programs and honor your choices.
6. How We Share Personal Information
Popmenu, our technology platform provider. When you use or submit information through our Popmenu-powered Site, App, menus, or ordering tools, you provide that information to both Tracks Lounge and Popmenu. Popmenu processes personal information as a service provider on our behalf to operate the Services and also collects and uses certain information on its own behalf as an independent business, including to operate, evaluate, improve, and market its own services, develop new services, and analyze restaurant-industry trends.

Payment processors. When you pay for an order, payment information is collected and processed by third-party payment processors.
Delivery providers. If you choose delivery, we may share your name, delivery address, telephone number, and order details with third-party delivery providers to complete the delivery.
Service providers. We may share personal information with other vendors that perform services for us. These providers are permitted to use personal information only to perform services for us.
Legal, safety, and compliance recipients. We may disclose personal information if we believe in good faith that disclosure is necessary to comply with applicable law, regulation, legal process, or governmental request; enforce our terms and policies; or protect the rights, property, or safety of our business, guests, employees, or others.
Business transfers. Personal information may be transferred to a buyer or successor in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of some or all of our assets.
The categories above exclude text-messaging originator opt-in data and consent; this information will not be shared with third parties.
7. Ratings, Reviews, and Other Public Content
The ratings and reviews features of our menus are designed for public consumption. Ratings and reviews you submit may be visible to the public, and the display name or handle and photograph associated with your guest account may be displayed alongside your reviews.
Please do not include information in a review that you do not want to be public.
Ratings and reviews are stored and displayed through the Popmenu platform and may remain available through that platform as described in Popmenu's privacy policy even if our relationship with Popmenu changes.
8. Your Choices
Email. You may unsubscribe from marketing emails using the unsubscribe link included in each marketing email. We may still send transactional messages, such as order confirmations.
Text messages. Reply STOP to a marketing text from us to stop receiving marketing texts.
Guest account. If you have a guest account, you may log in through our Site to update certain account information and manage available communication preferences.
Deletion. You may request deletion of your guest account and personal information as described below. Some information may be retained or deidentified as permitted or required by law.
Cookies and tracking. See Section 9 for information concerning cookies and tracking technologies.
App permissions and notifications. If applicable, you may disable notifications and revoke device permissions through your device settings.
9. Cookies and Tracking Technologies
Like most websites and apps, our Services use cookies and similar technologies. A "cookie" is a small data file placed on your device that helps the Services function and helps us understand how they are used.
Essential and functional cookies. These may include persistent cookies that remember preferences, settings, and login information between visits and session cookies that enable features while you browse and are deleted when you close your browser. Some features may not function properly without cookies.
Analytics technologies. Third-party analytics providers may place cookies to collect traffic and activity data and provide usage metrics. These may include Google Analytics, Snowplow, and FullStory, including session-replay tools that visually record interactions with portions of the Services, such as ordering and checkout flows.
Most browsers allow you to erase cookies, block cookies, or receive a warning before a cookie is set.
Our Services do not respond to browser "Do Not Track" signals, for which no industry standard has been adopted.
10. Our Mobile App
If Tracks Lounge offers a mobile App powered by the Popmenu platform, this Privacy Policy also applies to that App.
Device permissions. The App may request access to device features such as notifications. You can grant or revoke these permissions through your device settings.
App usage information. When you use the App, servers may automatically record information sent by your device, including device model and identifiers, operating-system information, user settings, and information concerning your use of the App. The App may also send crash reports in the event of an error for analysis and troubleshooting.
App analytics. The App may use third-party analytics services, including Google Analytics, Snowplow, and FullStory.
Account deletion. If you create an account in the App, account-deletion functionality may be available through Profile > Delete.
11. Data Retention
We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, unless a longer period is required or permitted by law.
Factors we use to determine retention periods include the duration of our relationship with you, whether information is necessary to provide the Services, maintain business records, or handle disputes, and applicable legal, tax, accounting, and audit obligations.
When personal information is no longer needed, we may delete, deidentify, or aggregate it.
12. U.S. State Privacy Rights
Depending on where you live and whether applicable state privacy laws apply to us, you may have some or all of the following rights with respect to your personal information, subject to applicable legal limits and exceptions:
- Right to know/access: To confirm whether we process your personal information and access it, including, where applicable, the categories collected, sources, purposes, and categories of recipients.
- Right to portability: To obtain a copy of personal information you provided to us in a portable format.
- Right to correct: To correct inaccurate personal information.
- Right to delete: To request deletion of your personal information.
- Right to opt out: To opt out of the "sale" or "sharing" of personal information, "targeted advertising," and certain "profiling," as those terms are defined under applicable state laws.
- Rights relating to sensitive personal information: To limit certain uses of sensitive personal information or, in some states, require consent before such information is processed.
- Right to non-discrimination: Not to receive discriminatory treatment for exercising applicable privacy rights.
Sensitive Information
We use sensitive personal information such as dietary or dining preferences you voluntarily share—which may reveal information concerning health, religious beliefs, or disabilities—only to provide and personalize the Services you request and for other purposes permitted by applicable law, and not to infer characteristics about you.
Where applicable law requires consent to process sensitive information, by choosing to provide dietary or dining preferences or enabling applicable location features, you consent to our use of that information for these purposes. You may withdraw consent by deleting preferences from your profile or disabling applicable location permissions in your device settings.
How to Submit a Request
You, or an authorized agent where permitted by law, may submit a privacy request by contacting Tracks Lounge at either of the phone numbers listed in the Contact Us section below.
We may need to verify your identity before acting on a request. Verification may require confirming information we have on file, such as the email address or telephone number associated with your account or orders.
We will respond within the period required by applicable law, generally within 45 days where applicable, with extensions where permitted. If we deny a request in whole or in part and applicable law provides a right to appeal, you may contact us to request an appeal.
Additional Information for California Residents
This subsection supplements the remainder of this Privacy Policy for California residents and is provided pursuant to the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA"), to the extent the CCPA applies to us.

We do not "sell" personal information, and we do not "share" personal information for cross-context behavioral advertising, as those terms are defined under the CCPA. We have no actual knowledge that we sell or share the personal information of consumers under 16 years of age.
Shine the Light. California Civil Code § 1798.83 permits California residents to request information regarding disclosures of personal information to third parties for those parties' direct-marketing purposes. We do not disclose personal information to third parties for their own direct-marketing purposes.
13. Children's Privacy
The Services are not directed to children, and we do not knowingly collect personal information from children under 13.
If we learn that we have collected personal information from a child under 13, we will delete it as soon as reasonably possible.
14. Security
We and our service providers use reasonable administrative, physical, and technical safeguards designed to protect personal information against unauthorized access, disclosure, use, alteration, or destruction.
No security measures are perfect, however, and no method of data transmission or storage can be guaranteed to be secure. Please protect your account credentials and promptly notify us of suspected unauthorized use of your account.
15. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. We will post the updated Privacy Policy on this page and revise the "Last Updated" date above.
If we make material changes, we will provide additional notice as required by applicable law, such as a notice on our Site or App.
